ISSUES

  • We have seen from time to time that anyone who ever stood up for the Kashmiris was silenced or had to face serious backlash by India. Despite all the international conventions on Human Rights, situation in Kashmir remains unchanged. India often bans access to newspapers, internet or cellular connection or harsh censorship barring Kashmiris from their right to information.
  • A free press reporting on the issues that shape our lives is a key building block of any society. Yet in Indian Occupied Kashmir, journalists face repression and attacks. During conflict, it can get worse, such as in Kashmir where journalists reporting on human rights abuses have been arrested, tortured and killed. Moreover, whenever, the situation worsens in Kashmir, the internet users of the area are blocked from all using social media services such as Twitter, Facebook, WhatsApp, YouTube, etc. Not only this, journalists, activists and academicians face severe censorship whenever Kashmir sensitive articles, news pieces or posts are released. Even Facebook was criticized in 2016, when it censored dozens of posts and user accounts after the death of Burhan Wani.

YFK CALLS FOR

  • Prisoners of conscience should be released from captivity immediately in Indian occupied Kashmir without imposition of any condition.
  • All actions carried out against those executing their fundamental rights – freedom of expression and protest, should be stopped.
  • Valid disagreements should not be repressed using force.
  • Access to information should be granted to all Kashmiris.
  • Publication ban on newspapers should be immediately lifted.

ISSUES

Torture normally takes place in seclusion. India resorts to covering or negating torture rather than initiating just and fair investigations whenever any pro-Kashmir forum forwards a complaint.

There are various reasons why torturers do not fear prosecution, getting arrested or punishment. These include:

  • Absence of political will- exceptionally when the government is involved in the torture.
  • Rights of Kashmiris have never been India’s priority.

YFK CALLS FOR

  • Clear understanding of the term torture
  • Inculcation of awareness about the term into the people. People need to realize that there are no grey areas. Even depriving anyone of sleep in defined as torture.
  • India to realize that cruelty and humiliation should not be tolerated – whether or not they qualify as torture.
  • Governments as well as international community to set up systems to record key stages of arrest and imprisonment, so that if people in authority behave illegally or abusively at any time, they can be prosecuted.
  • Proper and fair process for investigating torture and prosecuting those responsible.
  • Political will and commitment to enforcing rule of law.

PELLETS

Lead loaded pellets have been used indiscriminately against Kashmiris as they raise their voices for freedom. Indian police claim of pellet guns as a “non-lethal weapon” has left many injured, blind and dead. Pellets penetrate delicate tissues of the skin and eye which are most vulnerable to damage. These were introduced in 2010 by Indian police during a protest which left 100 dead.

One cartridge of pellet gun may contain hundreds of pellets. When fired, the cartridge bursts and immediately throws these ball bearing resembling structures at a single point.

YFK URGES

  • Immediate halt to the usage of pellet guns in the valley.
  • International community to strongly condemn the use pellet guns as it is not in line with international standards on the use of force.
  • Objectives of the Indian police should be achieved in a less harmful way with other devices which can be more accurately aimed, and where the risk of harm can be better controlled.
  • Special care and help to be provided to those who have already been blinded by pellets.

SEXUAL ASSAULT

Every year, hundreds of women and girls are abused sexually in Kashmir. In 1991, Indian army soldiers allegedly rapped 23 to 100 women in Kunan and Poshpora villages of Kashmir during search operation. Twenty-six years have passed and yet no action or even inquiry conducted to probe the incident. Violence against women takes other forms too such as molestation and harassment. Women must be given the right to make decision about their own body.

“Yes, in turns. About ten times during the night. They would wrestle with each other.” Sameera Begum, rape-survivor, Kunan Poshpora. HALF WIDOWS

The term half-widow is usually affiliated with those Kashmiri women whose husbands have disappeared and still couldn’t be found. Therefore, the wives do not know whether their husbands are still alive or dead.

The term became common around two and a half decades ago, when men started to disappear, usually captured by the forces, leaving behind their wives. Half-widows face financial difficulties because they cannot access their husband’s property or bank accounts since death certificates are required for this. But these are not available since their husbands are not officially recognized as deceased. Under Muslim personal law, a person cannot be declared dead until seven years after their disappearance.

Half-widow is a term given to Kashmiri women whose husbands have disappeared and were still missing during the ongoing conflict in Kashmir. These women are called "half-widows" because they have no idea whether their husbands are dead or alive.
