Burhanuddin Muzaffar Wani- a Kashmiri freedom fighter, became a target of Indian forces atrocities and was martyred on 8th July 2016 during an encounter with Indian Occupied Kashmir forces.
Following his death, over 50,000 people congregated to mourn his death and to attend his funeral. During the funeral procession of Burhanuddin Muzaffar Wani, 29 more people lost their lives and more than 250 were injured as a result of a clash with Indian security forces. Such actions are a grave violation of human rights; committed by Indian security forces within the parameters of Indian Occupied Kashmir.
An independent inquiry is appealed to look into the extrajudicial killing of Burhanuddin Muzaffar Wani and the innocent protestors. The dismal condition of unarmed Kashmiris need the attention of the international community, as they are being brutally killed, blinded and injured by Indian forces in the area.
It needs to be stated that Indian Occupied Kashmir is a disputed territory as recognized by United Nations in its resolution number 47.
In July, last year, Pakistan’s permanent representative to UN – Dr. Maleeha Lodhi, at an International forum in New York, demanded independent judicial inquiries of the killings and urged the international community to raise their concerns regarding human rights violation in Kashmir.
Moreover, such actions are clear violations of Article 3 and Article 10 of Human Rights of Universal Declaration; which states that not only is everyone legally and morally entitled to the right to life, liberty and security, but is also entitled to full equality of a public hearing by an independent and impartial tribunal, in the determination of his rights and obligations and of any criminal charge against him.
RECOMMENDED ACTIONS: YFK appeals for the following immediate measures to be taken:
- Independent and immediate judicial inquiry of the killing of Burhanuddin Muzaffar Wani and other Kashmiris during the procession to be held.
- The situation in Indian Occupied Kashmir should be referred to the International Criminal Court by United Nation’s Security Council.
